These Terms and Conditions (“Terms”) govern the use of the services provided by Nomads UAB, registered at Mokslininkų g. 2, LT-08412 Vilnius, Lithuania, company code 302441263 (“NomadsBio”, “we”, “us”, “our”), through our website nomadsbio.com (the “Site”) and associated services including our skin microbiome testing service (the “Test” or “Service”).
By ordering and using our Service, you agree to these Terms and to our Privacy Policy (which forms part of these Terms). Please read them carefully before placing an order.
1. Service Overview
1.1. NomadsBio provides a wellness-oriented skin microbiome analysis. The Service includes:
A sample collection kit and instructions;
Laboratory analysis of the microbiome from your submitted skin sample;
A personalized report (the “Report”) with information about your skin microbiome composition and general wellness insights.
1.2. The Service is intended for informational and educational purposes only.
It is not a medical or diagnostic service and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for any health concerns.
2. Contract Formation
2.1. By placing an order on the Site, you make an offer to purchase the Service in accordance with these Terms.
2.2. The contract is concluded once we send you an order confirmation email. We reserve the right to refuse or cancel an order before confirmation if necessary.
2.3. You must be at least 18 years old or have the consent of a legal guardian to use the Service.
3. Prices and Payment
3.1. Prices are stated in euros (EUR) and include VAT unless otherwise noted.
3.2. Payment is due at the time of ordering. Accepted payment methods are listed on our Site.
3.3. We reserve the right to update prices or correct typographical errors at any time before the contract is concluded.
4. Delivery, Sample Collection and Return
4.1. After purchase, you will receive a sample collection kit and instructions.
4.2. You must follow the provided instructions carefully and return the sample within the specified timeframe.
4.3. You are responsible for proper packaging and timely return shipping of the sample. Improper collection or delayed shipping may compromise analysis results.
4.4. We are not responsible for losses or delays caused by postal or courier services.
5. Processing and Reporting
5.1. Upon receipt of your valid sample, the laboratory will perform microbiome analysis using validated scientific methods.
5.2. The Report will be delivered digitally (e.g., via email or secure online portal) typically within the timeframe specified on our website.
5.3. The analysis is performed with due care and professional standards. However, microbiome data are inherently variable, and results may not be reproducible or definitive.
6. Right of Withdrawal (EU Consumers)
6.1. If you are a consumer residing in the EU or EEA, you have the right to withdraw from the contract within 14 days after receiving the Test kit without giving any reason.
6.2. To exercise this right, you must notify us in writing at info@nomadsbio.com before the 14-day period expires.
6.3. However, once you have used the kit and submitted your sample, the Service is considered partially performed, and you lose the right to withdraw under Article 16(c) of the EU Consumer Rights Directive (2011/83/EU).
6.4. If you withdraw within the allowed period, we will refund your payment (excluding return shipping costs) within 14 days after receiving your withdrawal notice.
7. Refunds and Replacements
7.1. If your kit or sample is damaged or unusable, please contact info@nomadsbio.com.
7.2. We may offer a replacement kit or refund at our discretion depending on the reason for failure (e.g., postal damage, lab rejection).
7.3. Refunds will be processed to the original payment method within a reasonable timeframe.
8. Intellectual Property
8.1. All intellectual property rights related to the Site, software, laboratory methods, reports, and materials belong to NomadsBio or our licensors.
8.2. You may download and use your Report for personal, non-commercial use only.
8.3. You may not reproduce, publish, distribute, or use our materials for commercial purposes without our prior written consent.
9. Use of Data
9.1. By submitting a sample, you grant NomadsBio the right to analyze it for the purpose of delivering your Report.
9.2. You also grant us a non-exclusive, royalty-free license to use anonymized or aggregated data derived from your sample and report for research, product development, and statistical purposes, in compliance with GDPR.
9.3. Personal data is processed strictly according to our Privacy Policy and applicable data protection laws (including the EU General Data Protection Regulation 2016/679).
10. Privacy and Data Protection
10.1. We are committed to protecting your privacy and personal data.
10.2. Our Privacy Policy explains how we collect, process, and protect your personal data, including your genetic or microbiome-related information.
10.3. We may use trusted third-party processors (laboratories, couriers, IT service providers) bound by confidentiality and data protection agreements.
10.4. If data is transferred outside the EU/EEA, we ensure appropriate safeguards (e.g., Standard Contractual Clauses).
11. Liability
11.1. To the fullest extent permitted by law, NomadsBio’s liability is limited to direct damages not exceeding the amount paid for the Service.
11.2. We are not liable for indirect, incidental, consequential, or punitive damages (including loss of profit or data).
11.3. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Lithuanian or EU law.
12. Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, strikes, transport disruptions, or governmental restrictions.
13. Governing Law and Dispute Resolution
13.1. These Terms and any related contract are governed by Lithuanian law, subject to mandatory consumer protection rules of the EU/EEA.
13.2. Disputes shall be resolved by the courts of the Republic of Lithuania, unless EU consumer law provides otherwise.
13.3. EU consumers may also submit complaints via the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
14. Final Provisions
14.1. If any clause of these Terms is found invalid, the remaining provisions shall remain in full force.
14.2. We may modify these Terms from time to time. The version applicable to your order is the one in force at the time of purchase.
